In Greene County district court Deividas Xavier Guinan, 30, of Des Moines was sentenced Jan. 11 to 180 days in jail after he changed his plea to guilty to a charge of operating while intoxicated. All but two days of the jail sentence was suspended and he was placed on probation for one year to the Iowa Department of Correctional Services. He may complete the Des Moines Area Community College alcohol education program in lieu of the jail time. He must complete a community college driving drivers school. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Guinan was fined $1,250 with a $187.50 surcharge; one-half will be waived if he obtains a temporary restricted license. He must pay an amount not to exceed $600 restitution for his court appointed attorney’s fees and $362.37 court costs. (Sentencing: Honorable Joseph B. McCarville)
Jason M. Pirie, 39, of Callender was sentenced Jan. 19 to 180 days in jail after he changed his plea to guilty to a charge of possession of methamphetamine- second offense. All but two days of the jail sentence was suspended and he was placed on probation for one year to Boone/Greene County Probation. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He was fined $430 with a $64.50 surcharge; both were suspended. He must pay an amount not to exceed $750 restitution for his court appointed attorney’s fees and $312.76 court costs. A charge of possession of marijuana- second offense was dismissed. Joshua Kelly Uranga, 41, of Pilot Mound was sentenced Jan. 11 to 30 days in jail with credit for time served after he changed his plea to guilty to a charge of theft- third degree. He was fined $855 with a $128.15 surcharge. He must pay $855 restitution to HyVee, an amount not to exceed $600 restitution for his court appointed attorney’s fees, and $165.74 court costs. Zachary Lee Flinn, 28, of Perry was sentenced Jan. 18 to 10 years in prison after he changed his plea to guilty to a charge of possession with intent to deliver methamphetamine, less than 5 grams. The prison term was suspended and he was placed on probation for 2-5 years to the Department of Correctional Services. He must complete the recommendations of a substance abuse evaluation. Flinn was fined $1,000 with a $150 surcharge; both were suspended. Court costs were $216.51. Charges of possession of methamphetamine- third or subsequent offense, and ongoing criminal conduct- influence enterprise were dismissed. (Sentencing: Honorable Christopher C. Polking)
Derek Eugene Ott, 30, of Fort Dodge was sentenced Jan. 11 to 30 days in jail, concurrent to the term in another Greene County case, after he changed his plea to guilty to a charge of possession of methamphetamine. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Ott was fined $430 with a $64.50 surcharge; both were suspended. A hearing will be scheduled to determine his ability to pay restitution for his court appointed attorney’s fees and court costs. A charge of possession of marijuana was dismissed. Austin Ray Higgins Owens, 17, of Jefferson was granted a deferred judgment after he changed his plea to guilty to a charge of domestic abuse assault impeding blood/air flow causing bodily injury. He was placed on probation to the Department of Correctional Services for three years. He must complete a batterers education program, and he must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. A judgment for a $1,250 civil penalty was entered but suspended. The court ruled his in unable to pay restitution for his court appointed attorney and court costs. (Sentencing: McCarville)
Humberto Reyes Tolentino, 52, of Fort Dodge was sentenced Jan. 19 to four days in jail with credit for time served after he changed his plea to guilty to a charge of driving while license barred. He was fined $1,000 with a $150 surcharge. He must pay an amount not to exceed $1,200 restitution for his court appointed attorney’s fees and $227 court costs. (Sentencing: McCarville)
Tammy Ann Tolsdorf, 57, of Grand Junction was sentenced Jan. 19 to five years in prison after she pleaded guilty to a charge of possession of methamphetamine- third or subsequent offense. The prison term was suspended and she was placed on probation to the Department of Correctional Services for two years. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. Tolsdorf was fined $1,025 with a $153.75 surcharge. She must pay $1,000 restitution for her court appointed attorney’s fees and $100 court costs. A charge of possession of marijuana- third or subsequent offense was dismissed. In a companion case in magistrate court in which Tolsdorf was charged with possession of drug paraphernalia, the case was dismissed with a judgment against Tolsdorf for $60 court costs. Tibben, 37, of Scranton, assault while display dangerous weapon, and in a separate case, theft- fourth degree; Nicholas Scott Weber, 21, of Jefferson, possession of marijuana- third or subsequent offense; Carly Jene Hubby, 42, of Ogden, driving while license barred; Richard John Sabus, 58, of Churdan, driving while license barred; Jesse Dean Hermansen, 32, of Jefferson, domestic abuse assault causing injury or mental illness; and Mark Henry Morrow, 61, of Carson, driving while license barred. A trial date was set for April 5 for Tibben, and for March 1 for all other defendants.
